It is illegal to discriminate against a person on the basis of a disabling condition. People's ignorance about HIV, however, may get expressed as prejudice and employment discrimination. Fear and concern about possible discrimination or loss of benefits has caused some PLWAs not to seek employment or to stay in their current job rather than disclose their HIV status in a new workplace.

There are federal and state laws that prohibit employment discrimination on the basis of disability. Understanding these laws can:
• Empower you in deciding whether to disclose your HIV status
• Help you make informed choices about where to work
• Ensure that you get what you need to perform your job well
